These Terms & Conditions apply to your use of the MOVE – Movement for Living Well website and, where applicable, to services purchased or booked through the website.

Please read them carefully before using the website or purchasing or booking a MOVE service.

1. About MOVE

MOVE – Movement for Living Well (“MOVE”, “we”, “us” or “our”) provides movement, Pilates, yoga, fascia-focused movement, Live Online classes, in-person studio classes, private sessions, retreats, professional education and related services.

2. Using This Website

By using this website, you agree to use it lawfully and in a way that does not interfere with the rights or use of the website by others.

The information provided on this website is for general information about MOVE and its services.

We make reasonable efforts to ensure that information on the website is accurate and up to date, but programmes, timetables, teachers, prices, availability and other details may occasionally change.

3. Our Services

MOVE services may include:

  • Live Online movement classes and programmes;

  • in-person group classes and courses at the MOVE Studio;

  • private and duet Pilates Equipment sessions;

  • class plans and class packs;

  • retreats;

  • workshops and special events;

  • professional education and teacher training; and

other movement and educational services advertised from time to time.

The precise content, price, duration, availability and conditions applicable to a service will be stated on the relevant webpage, booking page or booking confirmation.

4. Bookings and Additional Terms

Some MOVE services are subject to additional booking or participation terms.

These may include:

  • MOVE Live Online Terms & Conditions;

  • MOVE Live Online Liability Waiver & Participation Agreement;

  • MOVE Studio Terms & Conditions;

  • MOVE Studio Liability Waiver & Participation Agreement;

  • MOVE Retreats Terms & Conditions; and

specific terms applying to a particular course, workshop, training or event.

Where additional terms apply, they form part of your agreement with MOVE.

If there is a conflict between these general Website Terms & Conditions and specific terms applying to a particular service, the specific terms will take precedence in relation to that service.

5. Booking Platform

MOVE uses Momence to manage some bookings, class plans, class packs, customer accounts and related communications.

You may therefore be redirected from the MOVE website to Momence, or interact with an embedded Momence booking facility, when making or managing a booking.

You are responsible for ensuring that the information associated with your booking account is accurate and up to date.

6. Prices and Payments

Prices will be displayed in the currency applicable to the particular service.

MOVE services may therefore be offered in euros or, for certain existing or separately advertised services, another stated currency.

The price and currency applicable to your purchase will be made clear before payment is requested.

Online payments may be processed through third-party payment providers including Stripe.

Where applicable, services may also be paid for using another payment method specified by MOVE.

7. Cancellations, Credits and Refunds

Cancellation, credit and refund conditions vary according to the type of MOVE service purchased.

The conditions applicable to your booking will be set out in the relevant service-specific Terms & Conditions or booking information.

For example, Live Online classes, in-person classes, private sessions and retreats have different cancellation arrangements.

Please check the applicable conditions before making your booking.

Nothing in these Terms & Conditions affects any mandatory rights you have under applicable Portuguese or European Union consumer law.

8. Consumer Cancellation Rights

Certain purchases made online may be subject to statutory consumer cancellation or withdrawal rights.

However, different rules and exceptions may apply depending on the type of service purchased, including where a leisure service, accommodation or other service is provided on a specific date or during a specific period.

Where you ask MOVE to begin providing a service during a statutory withdrawal period, you may be required to pay for services already provided, where permitted by applicable law.

Nothing in these Terms & Conditions is intended to restrict any mandatory consumer rights available to you.

9. Physical Activity and Health

MOVE provides physical movement and exercise services.

Participation in physical activity carries inherent risks and you are responsible for exercising within your own abilities.

You should inform MOVE of any injury, medical condition, pregnancy, recent surgery or other circumstance that may materially affect your safe participation.

If you are unsure whether a MOVE class, programme or activity is suitable for you, you should seek appropriate advice from your doctor or another suitably qualified healthcare professional before participating.

Participation in individual exercises and activities is voluntary.

Specific participation requirements and responsibilities are contained in the relevant MOVE Liability Waiver or Participation Agreement.

10. Online Classes

When participating in a MOVE Live Online class, you are responsible for ensuring that you have:

  • sufficient clear and safe space in which to move;

  • suitable flooring and surroundings;

  • safe and appropriate equipment;

  • an adequate internet connection; and

a suitable device through which to participate.

MOVE cannot control the environment in which you participate remotely and cannot guarantee the quality of your individual internet connection or equipment.

The MOVE Live Online Liability Waiver & Participation Agreement contains the full conditions relating to online participation.

11. In-Person Classes

Participants attending the MOVE Studio must follow reasonable instructions relating to safe use of the studio and its equipment.

Equipment should only be used as instructed.

Specific booking, cancellation, make-up and participation conditions applicable to Studio services are contained in the relevant MOVE Studio Terms & Conditions and Liability Waiver.

12. Retreats

MOVE retreats are governed by separate MOVE Retreats Terms & Conditions.

Those terms include important information concerning deposits, balance payments, cancellations, accommodation, meals, travel, travel insurance, transfers and cancellation by MOVE.

Please read the Retreat Terms & Conditions before paying a retreat deposit.

13. Professional Education and Teacher Training

Professional education, workshops and teacher-training programmes may be subject to separate terms concerning payment, cancellation, attendance, certification, course materials and intellectual property.

Where separate terms are provided for a programme, those terms form part of your agreement with MOVE.

Completion of a course or training does not guarantee professional registration, employment, insurance eligibility or recognition by a particular professional or regulatory organisation unless MOVE expressly states otherwise.

14. Changes and Cancellation by MOVE

Occasionally MOVE may need to change a timetable, teacher, venue, class format, programme or other arrangements.

MOVE will make reasonable efforts to minimise disruption and communicate significant changes to affected customers.

If MOVE cancels a paid service and cannot provide a reasonable replacement or alternative, an appropriate credit or refund will be provided where applicable.

Specific cancellation provisions contained in the terms for a particular service will take precedence.

15. Intellectual Property

Unless otherwise stated, the content of this website and MOVE teaching materials, including text, photographs, graphics, videos, class materials, course materials, manuals and other original content, belongs to MOVE and/or the relevant rights holder.

Content is provided for your personal use in connection with MOVE services.

You may not reproduce, distribute, publish, sell, record, commercially exploit or make MOVE content or teaching materials available to others without prior written permission.

16. Recording Classes and Educational Content

You may not photograph, film, screen-record, audio-record or otherwise record MOVE classes, sessions, courses, workshops or educational materials without prior permission from MOVE.

Where MOVE proposes to photograph or record participants for promotional, educational or other purposes, appropriate information and, where required, consent will be obtained separately.

17. Website Links

The MOVE website may contain links to third-party websites or services.

These links are provided for convenience and information. MOVE does not control third-party websites and is not responsible for their content, availability, security or privacy practices.

You should review the applicable terms and privacy policies of third-party services you choose to use.

18. Technical Availability

MOVE will make reasonable efforts to keep its website and online services available but cannot guarantee uninterrupted or error-free access.

Access may occasionally be interrupted for maintenance, technical problems or circumstances outside MOVE's reasonable control.

19. Liability

MOVE will exercise reasonable care and skill in providing its services.

To the extent permitted by law, MOVE is not responsible for loss or damage arising from circumstances outside its reasonable control or from a participant's failure to follow reasonable instructions, use suitable equipment, disclose relevant information or participate within their own capabilities.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Nothing in these Terms & Conditions limits your mandatory rights under applicable consumer law.

20. Events Beyond Our Reasonable Control

MOVE will not be responsible for delay, cancellation or inability to provide a service resulting from circumstances beyond its reasonable control.

Such circumstances may include severe weather, natural disaster, fire, public-health restrictions, government action, transport disruption, venue closure, interruption of utilities or communications, or other exceptional circumstances that could not reasonably have been prevented.

Where this occurs, MOVE will make reasonable efforts to provide an appropriate alternative, credit or other solution where applicable.

21. Privacy and Personal Information

MOVE processes personal information in accordance with the MOVE Privacy Policy.

Please read the Privacy Policy for information about how we collect, use, store and share personal information and about your data protection rights.

22. Changes to These Terms

MOVE may update these Terms & Conditions from time to time to reflect changes to services, systems, business practices or legal requirements.

The current version will be published on this website.

Changes will not retrospectively remove mandatory rights you already have in relation to an existing purchase.

23. Applicable Law

These Terms & Conditions are governed by applicable Portuguese law.

If you are a consumer resident elsewhere in the European Union or another jurisdiction, you may also benefit from mandatory consumer protections applicable in your country of residence.

Nothing in these Terms & Conditions deprives you of any mandatory legal rights or protections that apply to you.
